Fitculator Athletes Terms of Service

Effective Date: May 27, 2025

Article 1 (Purpose)

These Terms aim to define the rights, obligations, and responsibilities between the Company and users regarding the use of internet-related services (hereinafter "Services") provided by Fitculator Athletes (hereinafter "Company").

Article 2 (Definitions)

  1. "Service" means all exercise and health management related services provided by the Company.
  2. "User" means members and non-members who access the Company's services and receive services provided by the Company in accordance with these Terms.
  3. "Member" means a person who has registered as a member by providing personal information to the Company, continuously receives information from the Company, and can continuously use services provided by the Company.

Article 3 (Specification, Explanation, and Amendment of Terms)

  1. The Company posts the contents of these Terms, company name, representative's name, business address, phone number, email address, business registration number, etc., on the initial screen of the service so that users can easily identify them.
  2. The Company may amend these Terms when deemed necessary.
  3. When the Company amends the Terms, it will specify the effective date and reasons for amendment and announce them together with the current Terms according to the method in Paragraph 1, from 7 days before the effective date until the day before the effective date.

Article 4 (Provision and Change of Services)

  1. The Company performs the following tasks:
    • Exercise planning and management services
    • Health information and data analysis services
    • Community services
    • Other tasks determined by the Company
  2. The Company may change all or part of the services being provided according to operational and technical needs.

Article 5 (Formation of Service Use Contract)

  1. A use contract is formed when a user fills in member information according to the member registration form and expresses intention to agree to these Terms.
  2. The Company may not approve applications falling under any of the following items or may terminate the use contract afterwards:
    • Cases using a false name or another person's name
    • Cases providing false information or not filling in content presented by the Company
    • Cases where minors under 14 years old do not obtain consent from legal representatives

Article 6 (Changes to Member Information)

  1. Members can view and modify their personal information at any time through the personal information management screen.
  2. When information provided during member registration changes, members must make corrections online or notify the Company of such changes via email or other methods.

Article 7 (Personal Information Protection Obligations)

The Company strives to protect members' personal information in accordance with relevant laws including the Information and Communications Network Act. Related laws and the Company's Privacy Policy apply to the protection and use of personal information.

Article 8 (Member Obligations)

  1. Users must not engage in the following acts:
    • Registering false information during application or changes
    • Misappropriating others' information
    • Changing information posted by the Company
    • Transmitting or posting information other than that determined by the Company (such as computer programs)
    • Infringing on intellectual property rights including copyrights of the Company and third parties
    • Damaging the reputation of the Company and third parties or interfering with their business
    • Publishing or posting obscene or violent messages, images, sounds, or other information contrary to public order and morals on the service

Article 9 (Service Provision and Interruption)

  1. The Company provides services 24 hours a day, 365 days a year in principle. However, the Company may temporarily suspend service provision for system regular inspections, expansion, and replacement, and service interruptions due to scheduled work are announced in advance through the service.

Article 10 (Contract Termination and Use Restrictions)

  1. When a member wishes to terminate the use contract, they must directly apply for termination to the Company online.
  2. The Company may terminate the use contract or suspend service use for a specified period without prior notice when members fall under any of the following reasons:
    • Registering false information during subscription application
    • Interfering with others' service use or misappropriating their information, thereby threatening e-commerce order
    • Using services to engage in acts prohibited by laws or these Terms or contrary to public order and morals

Article 11 (Compensation for Damages)

The Company shall not be liable for any damages incurred by members in relation to services provided free of charge, except when such damages are caused by the Company's gross negligence.

Article 12 (Disclaimer)

  1. The Company is exempt from responsibility for service provision when unable to provide services due to natural disasters or equivalent force majeure.
  2. The Company is not responsible for service use obstacles caused by members' fault.
  3. The Company is not responsible for the reliability, accuracy, etc., of information, materials, and facts posted by members in relation to services.

Article 13 (Governing Court)

Korean law applies to disputes arising between the Company and members regarding service use, and lawsuits arising from such disputes shall be filed in Korean courts with jurisdiction under the Civil Procedure Act.

Article 14 (Refund Policy)

  1. Refund Request Period
    • Refund requests can be made within 7 days of the payment date, and a full refund will be provided if the application has not yet launched.
  2. Non-Refundable Cases
    • If any app content has been accessed during the subscription period
    • Refund requests due to a change of mind
  3. Canceling Auto-Renewal
    • If you do not wish to be charged for the next billing cycle, please make sure to cancel auto-renewal via [My Page → Subscription Management] on our website.
    • Once canceled, no further charges will apply from the next billing cycle.
  4. Refund Process
    1. Submit a refund request through the in-app customer center or via email
    2. Our team will review the request and confirm eligibility
    3. If approved, refunds will be processed via your original payment method within 5 business days of the request date

Supplementary Provisions
